CHILD CUSTODY
It is generally accepted within the legal community that children develop better when parented by two biological parents. This belief is engrained in the law as legislators have attempted to pass laws that encourage that outcome. Even where a parent is initially restricted by court order from having access to their children, the law seeks to rehabilitate the parent in order to restore the natural order of the family structure.
Despite the legal bias in favor of inclusive parenting, many parents seek to obtain sole custody or restrictive parenting time. Parents who desire this result should carefully prepare their case for presentation to the Court in order to overcome the bias. Hiring an attorney with the knowledge and skills necessary to meet this challenge is indispensable.
Indiana requires both the custodial and noncustodial parent to file a notice with the court before moving and to serve the other parent with notice. This notice is required even if you are simply moving to another floor in an apartment building or across the street. Generally the notice should be filed at least 90 days prior to moving. A statute sets forth the required contents of the notice and allows the other parent to file an objection to the move. Proposed moves that complicate the exchange of the child or the non-custodian’s parenting time often result in objections and proceedings where a modification of custody or adjustment to the parenting time is sought.
